This policy lists what you must not do with FaxToFax. The main points: do not send advertising faxes to people who have not agreed to receive them; follow U.S. fax advertising law and similar laws elsewhere; do not use the service for fraud, harassment or illegal content; do not abuse the telephone network; and do not try to get around our security. We may limit or suspend accounts that break these rules. The policy applies to everyone who uses FaxToFax and forms part of our Terms of Service.
1. Who this policy applies to
This Acceptable Use Policy applies to every customer and every user of FaxToFax. Customers are responsible for making sure their users follow it. A breach of this policy is a breach of our Terms of Service.
2. Follow the law
You must use FaxToFax only for lawful purposes and in line with all laws that apply to you and to the people you fax, including laws on privacy and data protection, consumer protection, telecommunications, professional confidentiality, export controls and sanctions.
3. Fax advertising: TCPA and the Junk Fax Prevention Act
The U.S. Telephone Consumer Protection Act (47 U.S.C. §227), as amended by the Junk Fax Prevention Act of 2005, and the Federal Communications Commission's rules (47 C.F.R. §64.1200) strictly limit advertising by fax. Violations can lead to statutory damages for each fax sent. When you use FaxToFax:
- Do not send unsolicited advertisements. An advertisement is any material advertising the commercial availability or quality of any property, goods or services. You may send one only if the recipient has given prior express invitation or permission, or if all the conditions of the established business relationship exception are met.
- Include an opt-out notice where required. Where the law requires one, the first page must carry a clear and conspicuous notice that tells the recipient how to ask you not to send future advertisements, including a domestic telephone number and fax number, and a cost-free way to make the request.
- Honour opt-out requests promptly, and in any case within 30 days. Keep a do-not-fax list and stop sending advertisements to anyone who has asked you to.
- Keep records showing the permission or business relationship you rely on for each recipient.
- Do not send fax broadcasts to purchased, rented or harvested lists of fax numbers.
- Follow the rules in other countries. Many countries restrict fax marketing more strictly than the United States, for example by requiring prior consent. You must comply with the rules of each country you send to.
We may limit sending volumes, ask you to show the permission you rely on, or block sending to recipients who complain.
4. Sender identification
U.S. law (47 U.S.C. §227(d)) requires every fax to show, in a margin at the top or bottom of each page, the date and time it was sent, the name of the business, entity or individual sending it, and the telephone number of the sending machine or sender. FaxToFax adds this identification automatically to every page you send. You must:
- keep your organization or account name accurate and up to date;
- not remove, alter or hide the sender identification;
- not impersonate another person or organization, or misrepresent who is sending a fax; and
- send only from fax numbers you are authorized to use.
5. Prohibited content
You must not use FaxToFax to send, receive or store content that:
- is illegal, or promotes or facilitates illegal activity;
- is fraudulent, deceptive or misleading, including scams, phishing, fake invoices and fake legal or government notices;
- harasses, threatens, intimidates or abuses anyone, or incites violence or hatred;
- infringes intellectual property, privacy or other rights, or discloses personal information without a lawful basis;
- sexually exploits children; we will report such material to the authorities;
- is defamatory; or
- is designed to harm our systems or other people's systems, such as files containing malicious code.
6. Telephone network abuse
You must not:
- commit or assist toll fraud, or artificially inflate call or fax traffic (sometimes called traffic pumping);
- send faxes to premium-rate, high-cost or revenue-sharing numbers in order to generate revenue or charges;
- dial sequential or random numbers to find fax machines, or send faxes to numbers you know are not fax lines;
- flood a recipient with repeated or excessive faxes; or
- keep retrying numbers that have rejected or blocked your faxes.
7. Security and integrity
You must not:
- access, or try to access, accounts, data or systems you are not authorized to use;
- probe, scan or test the vulnerability of FaxToFax, except as allowed by our Vulnerability Disclosure policy;
- bypass or disable sign-in, two-step verification, automatic sign-out, access roles, rate limits, usage limits, retention controls or other security features;
- interfere with or overload the Service, including by denial-of-service attacks;
- upload or transmit malware;
- access the Service by automated means, such as scraping, except through interfaces we provide for that purpose; or
- reverse engineer the Service, except where the law allows it.
8. Account misuse
You must not share sign-in codes or verification codes, let others use your access, give false information when signing up, create multiple accounts to evade limits, suspensions or introductory pricing rules, or resell or sublicense the Service without our written agreement.
9. Health and other regulated information
Do not send, receive or store protected health information until you have signed our Business Associate Agreement on an eligible plan. For any sensitive document, check the fax number before sending and use a cover page with a confidentiality notice.
10. How we enforce this policy
We do not routinely read the contents of faxes. We may investigate when we receive a complaint, when transmission records suggest abuse, or when the law, a regulator or a carrier requires it. Depending on the seriousness of the issue, we may:
- warn you;
- limit sending volumes or block particular destinations;
- suspend sending, or suspend or terminate the account;
- release or block a fax number used for abuse; and
- cooperate with law enforcement, regulators and telephone carriers, and report illegal content where the law requires.
We will usually tell you what we are doing and why, unless doing so would be unlawful or would compromise an investigation or the security of others. Suspension or termination for breach of this policy does not entitle you to a refund. You are responsible for claims, fines and penalties that arise from your breach, as set out in the Terms of Service.
11. Reporting abuse
If you have received a junk fax or other abusive fax sent through FaxToFax, email support@faxtofax.com with "Abuse report" in the subject line. Please include the sending fax number, the date and time you received it, and if possible a copy of the first page. We will not disclose information about our customers to you except where the law requires. To report a security vulnerability, see our Vulnerability Disclosure policy.
12. Changes
We may update this policy to reflect changes in the law or in how the Service is misused. Material changes will be notified as described in the Terms of Service.
